Welcome to Knockouts Optics™ (“Knockouts Optics,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of our website, online store and related services, and purchases made through our store (collectively, the “Services”).

Our online store is powered by Shopify.

By using our Services or placing an order, you agree to these Terms. Nothing in these Terms excludes or limits consumer rights, warranties or remedies that cannot legally be excluded or limited.

We sell and deliver products to eligible addresses in Canada and the United States.

1. Using Our Services

You must be legally able to enter into a purchase agreement under the laws that apply to you, or use the Services under the supervision and authorization of a parent or legal guardian.

You agree to provide accurate information and use our Services lawfully.

You must not:

• Submit false, misleading or fraudulent information.

• Interfere with the operation or security of our website.

• Attempt to access systems or accounts without authorization.

• Upload malicious code or use the Services for unlawful activity.

• Infringe our intellectual property or the rights of others.

We may restrict access where reasonably necessary to address misuse, protect our customers or secure our Services, subject to applicable law.

2. Products and Product Information

We sell eyewear and related products for recreational sports, including pickleball.

We aim to provide accurate product descriptions, images, specifications, pricing and availability. Product appearance may vary slightly depending on screen settings, lighting and other factors.

We may update product listings, availability and prices for future purchases. Changes do not alter an existing order unless you agree or applicable law permits the change.

If we discover an error affecting your order, we will contact you where appropriate to explain the issue and any available options. Any correction, cancellation or refund will be handled in accordance with applicable law.

3. Orders and Acceptance

After you place an order, we will send an order confirmation to the email address provided at checkout.

We may review an order for product availability, payment authorization, suspected fraud or other legitimate issues. Any refusal or cancellation will be subject to applicable law.

If we cannot fulfill your order, we will notify you and refund any payment collected for the unfulfilled items, together with any other amounts required by law.

Please review your order details carefully. If you need to request a change or cancellation, contact sales@knockoutsoptics.com as soon as possible. We cannot guarantee changes once an order has been processed or shipped. This does not affect any cancellation rights provided by law.

4. Prices, Currency and Payment

Orders placed through our Canadian market are priced and charged in Canadian dollars (CAD). Orders placed through our United States market are priced and charged in United States dollars (USD).

The currency and order total shown at checkout apply to your purchase. Please confirm them before submitting payment.

Prices may change for future purchases. Applicable sales taxes are calculated and displayed at checkout where required.

We offer free standard shipping to eligible addresses in Canada and the United States. We also cover applicable customs duties, import taxes and customs clearance or brokerage fees associated with delivery of your order.

Any optional service carrying an additional charge will be disclosed before you complete your purchase.

Payments are processed through Shopify and third-party payment providers. Payment must be authorized before an order is processed. Your payment provider may apply its own currency conversion or transaction fees, which are separate from charges imposed by Knockouts Optics.

5. Shipping and Delivery

We deliver to eligible addresses in Canada and the United States, subject to product availability and shipping restrictions disclosed before purchase.

Standard shipping is free. We cover applicable customs duties, import taxes and customs clearance or brokerage fees for delivery of your order.

If a carrier requests payment of an import-related charge, contact sales@knockoutsoptics.com so we can arrange payment or reimbursement. Keep any notice or receipt relating to the charge.

Order processing times and estimated delivery times are provided through our website, checkout or order communications where available.

Delivery estimates may be affected by carriers, customs processing, weather and other circumstances. We will assist with delivery issues, and nothing in these Terms removes our obligations or your rights concerning delayed, missing or undelivered orders.

You are responsible for providing an accurate and complete shipping address. Contact us promptly if you notice an error.

If your order arrives damaged, is missing items or appears lost, please contact sales@knockoutsoptics.com so we can investigate and help resolve the issue.

6. Returns, Exchanges and Refunds

Our posted Return and Refund Policy explains our voluntary return window, product condition requirements, return process and any applicable return shipping arrangements.

Free outbound shipping and covered import fees do not, by themselves, determine who pays return shipping. Return shipping is addressed in our Return and Refund Policy, subject to applicable law.

Our voluntary return conditions do not restrict rights or remedies available under applicable law for defective, damaged, misdescribed or undelivered goods.

Where our Return and Refund Policy conflicts with mandatory consumer protections, those protections apply.

7. Product Use and Safety

Use our products according to the instructions, warnings and intended uses provided with the product or described on our website.

No eyewear can guarantee complete protection against every impact, injury or hazard. Sports and recreational activities involve risks.

Before using your eyewear:

• Inspect the frame and lenses for damage.

• Check that removable or magnetic components are securely attached.

• Follow the care and use instructions.

• Stop using the product if it is damaged, does not fit securely or appears unsafe.

• Use any additional protective equipment appropriate for your activity.

Any claim about impact resistance, UV protection or other performance characteristics applies only as described in the relevant product information. Do not assume certification to a particular safety standard unless we expressly identify that certification.

If you have prescription lenses fitted, consult a qualified eye-care professional about lens compatibility and suitability for your intended activity. Prescription lens services supplied by a third party are governed by that provider’s terms. Your statutory rights relating to our products remain unaffected.

This section does not release us from responsibility for defective products, inaccurate claims or other obligations imposed by law.

8. Accounts

If you create an account, keep your login details secure and your account information accurate.

Notify us promptly if you suspect unauthorized access.

We may suspend or close an account where reasonably necessary to address fraud, unlawful activity or misuse. Account closure does not remove our obligations concerning existing orders or your applicable consumer rights.

9. Discounts and Promotional Offers

Discounts and promotional offers are subject to the conditions disclosed with the offer, including any eligibility requirements, expiry dates, exclusions or usage limits.

Our first-order email signup offer is subject to the terms shown on the signup form and in the offer email.

Discounts must be applied before completing checkout unless the offer states otherwise. Whether discounts can be combined depends on the conditions of each offer and the options available at checkout.

Subscribing to promotional emails is optional. You can unsubscribe at any time using the link in our marketing emails. Unsubscribing does not affect an order already placed.

We may change or end promotions for future purchases, subject to applicable law and any commitments already made.

10. Intellectual Property

Our trademarks, logos, photographs, graphics, text, product designs and other website materials are owned by or licensed to Knockouts Optics and protected by applicable intellectual property laws.

You may browse and use our website for personal shopping purposes.

You may not reproduce, distribute, modify or commercially exploit protected materials without authorization, except where permitted by law.

11. Reviews and Other Submissions

If you submit a review or other content, it must reflect your honest experience and must not be unlawful, misleading or infringe another person’s rights.

You retain ownership of your content. By submitting it for publication, you give us permission to display and reproduce it in connection with our products and Services, subject to applicable law and any separate permissions required.

We may moderate content that contains spam, personal information, abusive material or other inappropriate content. We do not prohibit honest negative reviews.

12. Third-Party Services and Links

Our Services may include links to or integrations with third-party websites, applications or payment services.

Those providers operate under their own terms and privacy policies. We do not control independent third-party websites.

Using a third-party provider does not remove any responsibility we have under applicable law for our own Services or your purchase.

13. Privacy

Our Privacy Policy explains how personal information is collected, used and disclosed, including information processed through Shopify and our service providers.

Please review it for information about your privacy rights, email preferences and advertising choices.

14. Warranties and Consumer Rights

Our products are subject to applicable legal warranties and consumer protections, together with any additional written product warranty we provide.

Nothing in these Terms excludes rights relating to product quality, fitness for purpose, conformity with descriptions or other protections that apply by law.

Any voluntary warranty or return policy supplements those rights.

15. Website Availability and Responsibility

We aim to keep our website accurate, secure and available, but interruptions, maintenance and technical errors may occur.

If a technical issue affects an order or payment, please contact us so we can investigate.

Our responsibility for losses or damage is determined by applicable law. Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, or requires you to waive mandatory consumer rights.

16. Changes to Our Services

We may update or discontinue website features or products for future use and purchases.

These changes do not remove our obligations concerning orders already placed, warranties or applicable consumer rights.

17. Changes to These Terms

We may revise these Terms to reflect changes to our business, Services or legal requirements.

We will publish revisions on this page and update the “Last updated” date. We will provide additional notice or obtain consent where required by law.

Unless you agree otherwise or applicable law requires a different result, the Terms in effect when you place an order govern that order. Later revisions do not retroactively change an existing purchase.

18. Governing Law

Subject to mandatory consumer protections, these Terms are governed by the laws of Quebec and the federal laws of Canada applicable in Quebec.

If you live elsewhere, including in another Canadian province or the United States, you retain any mandatory rights and protections available under the laws that apply to your purchase.

Nothing in these Terms requires you to bring a claim in a location that applicable law does not permit, prevents you from accessing a competent court or requires mandatory arbitration.

19. Severability and No Waiver

If a provision is found invalid or unenforceable, it will not apply to the extent of that invalidity or unenforceability. The remaining provisions continue to apply where legally permitted.

Our failure to enforce a provision on one occasion does not waive our right to enforce it later.
